1. Agreement to Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Zendory ("we," "our," or "us") regarding your access to zendory.co and your purchase of fixed-price website builds, competitor analysis packages, and related digital deliverables (together, the "Services").
By using the site, submitting an intake or support request, or purchasing a Service, you agree to these Terms. If you do not agree, do not use the site or purchase a Service.
2. Nature of the Services
Zendory provides scoped digital services for businesses. Depending on the package, Services may include a custom landing page, service website, revenue website with a checkout or intake flow, website improvements, competitor reports, market summaries, or related digital work.
Each fixed-price website package is limited to the pages, forms, revision rounds, hosting term, and launch work listed for that package at checkout. Migrations, large catalogs, portals, regulated workflows, custom backend logic, and complex integrations require separate scope approval.
Strategic deliverables are informational and are intended to support business decisions, not replace legal, financial, medical, or other professional advice.
3. Eligibility
To purchase Services, you must be at least 18 years old, have authority to act for yourself or your business, and use the Services for lawful business purposes.
4. Orders, Pricing, and Delivery
4.1 Pricing
All prices are listed in U.S. dollars unless stated otherwise. The price shown at checkout controls your order. Prices and package details may change before purchase but will not retroactively change a completed one-time order.
Zendory-hosted delivery is the recommended website-build path and includes the first 12 months of hosting. After that term, hosting renews at $149 per year for Landing and Service builds or $249 per year for Revenue builds. Building inside Squarespace, WordPress, Wix, Shopify, or Webflow adds $395 to the selected website package, and that provider's subscription, apps, themes, transaction fees, and other charges remain separate.
4.2 Payment
Payment is due at checkout unless we agree otherwise in writing. By submitting payment, you confirm that you are authorized to use the selected payment method.
4.3 When Work Starts
Payment reserves the purchased scope. Project work starts when payment has been received and Zendory begins project-specific review, writing, design, development, research, or platform setup. If required intake details, assets, access, or scope decisions are missing, Zendory may wait to start and ask for them first.
4.4 Delivery Timing
Services are delivered digitally. Any stated timeline begins after the required intake, content, access, and scope decisions are complete. Timing may change if information arrives late, the scope changes, a third-party platform causes delays, or feedback is not provided promptly.
5. Client Responsibilities
To help us deliver accurately and on time, you agree to provide complete and accurate intake information, approved copy and assets, domain details, and any access reasonably required for the purchased scope. You must have the right to use everything you supply.
Do not send account passwords through ordinary forms or email. When platform access is required, use that provider's role, collaborator, or invitation feature where available. You remain responsible for your accounts, domain registration, third-party subscriptions, legal notices, claims, and final approval of business-specific content.
6. Website Hosting, Domains, and Handoff
You keep ownership of a domain you already own or purchase. Domain registration and renewal are separate from the website-build price. Zendory may connect or help configure the domain, but a registrar transfer is normally unnecessary.
The first 12 months of Zendory hosting are included with a fixed website build. Before the next paid term, you may ask us not to renew. If hosting ends, you may request a reasonable export or handoff of your final site files and customer-owned content where technically available. We will not hold your domain or customer-owned content solely because you decline renewal.
Exports do not include Zendory's private systems, credentials, or licensed third-party materials that cannot legally be transferred. Another provider may not support the same site format, and migration, reimplementation, DNS work, or setup on a new platform is not included unless stated in writing.
7. Revisions, Approval, and Inactive Projects
A revision round means one consolidated set of written feedback on the work included in the purchased scope. Landing builds include one written revision round; Service and Revenue builds include two. Additional rounds, new pages, new functionality, a changed direction, or work outside the original intake may require a separate quote.
You are responsible for reviewing names, claims, prices, links, legal language, contact details, and other business-specific content. Written approval or a written request to launch authorizes Zendory to publish the approved version.
Silence is not approval. If required content, access, feedback, or approval is not provided, Zendory may pause the project and cannot hold the original delivery window indefinitely. After reasonable follow-up, a long-inactive project may be closed as abandoned for scheduling purposes. Completed work and your ownership rights are not forfeited, but a restart date and any requested scope changes must be confirmed in writing.
8. Cancellation and Refunds
You may request cancellation at any time. Refund eligibility depends on whether project-specific work has started, what has already been completed, and whether non-refundable third-party costs have been incurred. The full rules are in our Refund & Corrections Policy.
After delivery, the primary remedy for a material service issue is correction, clarification, or completion of the promised scope. Canceling hosting does not undo or refund a completed website build.
9. Ownership and Intellectual Property
You retain ownership of the content, trademarks, images, domain, and other materials you provide. After full payment, you may use the final custom website pages and final digital deliverables created specifically for your order for your business.
Zendory retains ownership of its pre-existing code, tools, templates, processes, systems, know-how, branding, and reusable components. Third-party software, fonts, themes, plugins, stock assets, and platforms remain subject to their own licenses. Purchasing a Service does not transfer those underlying rights.
10. No Guarantees or Performance Promises
Zendory does not guarantee revenue, conversion rates, search rankings, response rates, paid-media performance, market share gains, or any other business outcome. Results depend on factors outside our control, including the offer, market, audience, traffic, operations, platform changes, and client follow-through.
11. Prohibited Conduct
You agree not to misuse the site or Services, including by attempting unauthorized access, interfering with site operations, violating applicable laws, or using deliverables in misleading, unlawful, or harmful ways.
12. Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENDORY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENDORY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PURCHASED SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT SPECIFIC SERVICE.
14. Indemnification
You agree to indemnify and hold Zendory harmless from claims, liabilities, damages, and expenses arising from your misuse of the site, your violation of these Terms, or your use of the deliverables in violation of law or third-party rights.
15. Termination
We may suspend or terminate access to the site or refuse service if we believe you have violated these Terms, acted fraudulently, or created risk for Zendory or others.
16. Governing Law
These Terms are governed by the laws applicable in the United States, without regard to conflict of law principles, unless a different governing law is required by applicable law.
17. Changes to These Terms
We may update these Terms from time to time. Continued use of the site after changes take effect constitutes acceptance of the revised Terms.
